How it works
The template follows what Vietnam's Housing Law 27/2023/QH15 (in force since 1 August 2024) asks a housing contract to contain: the parties' names and addresses, the property, the price, payment time and method, handover, the term, rights and obligations, the effective date, the signing date and signatures (Article 163). The lease clauses follow the Civil Code 2015, Articles 472–482: handing over, repairs, using the property as agreed, paying the rent and giving it back in the same condition apart from normal wear.
A house lease does not have to be notarised or certified unless both of you want it (Housing Law Article 164(2)); it takes effect on the date you agree, or on signing. Ending a lease unilaterally is limited to the cases in Article 172 and needs at least 30 days' written notice unless the contract says otherwise. The rent, deposit and total are written in figures and in Vietnamese words, the way Vietnamese contracts usually state money.
Checked 29 October 2026 against the sources listed on this page. This is a template to adapt, not legal advice. Renting by the night can also fall under Vietnam's tourism accommodation rules, which this tool does not cover; ask your ward or a lawyer if you are unsure.
- total for a short stay = price per night × nights
- lease term = calendar months from the start date to the end date, end date included

Questions hosts ask
Does a rental contract in Vietnam need to be notarised?
No. Article 164(2) of Housing Law 27/2023/QH15 says house leases need no notarisation or certification unless the parties want it. The contract then takes effect on the date you agree, or on the day you sign.
Can a landlord in Vietnam end a lease early?
Only in the cases in Article 172 of the Housing Law, such as rent unpaid for 3 or more consecutive months, using the home for another purpose or subletting without consent. The party ending it must give at least 30 days' written notice unless the contract says otherwise.
Can I use this contract with a foreign tenant?
Yes. Choose Vietnamese + English and the passport option for the tenant; the Vietnamese text prevails if the two differ. The foreign tenant's temporary residence must also be declared — our foreign guest registration tool explains how.
Can I sublet an apartment I rent myself?
Only with the owner's agreement: Article 170(4) of the Housing Law and Article 475 of the Civil Code allow a sublease only when the lessor consents. Get that consent in writing before you list it.
